Step 3 – Process Design
Based on your goals, circumstances, complexity and budget, we work together to design the process that best supports your family. This includes determining the role of the financial specialist, mediator, lawyers and any other professionals. The result is a tailored pathway that provides the appropriate level of support, legal involvement and financial guidance throughout the process.

I actually like this second version more because it reinforces that you're designing a process, not selling one.

One other thought to keep in your notes for later. If the Sterling Financial Ecosystem becomes your overarching methodology, the language could eventually become:

That sequence tells a compelling story:

To me, that's a stronger narrative than the traditional "meet → negotiate → settle" model because it highlights the thoughtful design and analysis that distinguish your approach.

There are several ways we can structure my involvement, depending on what both of you feel most comfortable with and how you would like legal counsel to participate throughout the process.

Financial Consulting

I work with you and your lawyer to analyze proposals, prepare financial projections, evaluate settlement options, and help develop or respond to offers. The negotiations primarily take place between counsel while I provide financial analysis, strategic guidance and decision support.

Financial Co-Mediation

I work alongside a lawyer-mediator, with each of us bringing our respective expertise to the mediation process. My role is to help both of you understand the financial issues, prepare financial projections, develop and evaluate settlement options, and work toward mutually acceptable solutions. The lawyer-mediator facilitates the legal aspects of the discussions and prepares the separation agreement once a resolution has been reached.

I can recommend several experienced lawyer-mediators who work well within this model, and together we can determine who is the best fit based on your circumstances, personalities and the legal issues involved. Once the agreement has been prepared, each of you has the opportunity to obtain independent legal advice before signing.

Mediate/Collaborate (Collaborative Light)

I facilitate the mediation process while we work through the financial issues and develop potential solutions. At key stages, we bring your lawyers into the discussions to provide joint legal advice on the options being considered. You each have the opportunity to meet privately with your own lawyer before returning to mediation, where we continue developing and evaluating options using both legal guidance and financial projections before working toward resolution.

Full Collaborative

The lawyers are involved throughout the process as members of the collaborative team. Rather than separating the legal and financial discussions, we work through the issues together, integrating legal, financial and strategic guidance as decisions evolve. There is ample opportunity to pause, consult privately with your lawyer, reflect on the options, and then reconvene when you are ready. Financial projections and option evaluation remain an integral part of the process, helping everyone understand the practical implications of the available solutions before decisions are made.

Choosing the Right Approach

 

There is no one-size-fits-all process. Every family is different, and the most effective approach depends on your circumstances, your goals, the complexity of the issues, your budget and the level of legal involvement that feels right for both of you. Ultimately, the right process is the one that allows both of you to participate comfortably and make informed decisions.
